§ 7-5-1. Alteration or obstruction of drainage works or ditches.

  • (a)

    Districts under 1903 act. It shall be unlawful for any person, without permission or authority from the board of directors of any drainage district in the county organized under an act of the legislature of this state entitled "An act to provide for the organization and government of drainage districts, for the drainage of agricultural lands other than swamp and overflowed lands, and to provide for the acquisition or construction thereby of works for the drainage of the lands embraced within such districts" and approved March 20, 1903, and acts amendatory thereof, to dig in, upon or through any of the works of any such district, or impair, remove or obstruct any of such works or any ditch, pipe, aqueduct or bridge constituting a part of any such works, whereby the efficiency of such works may be impaired or endangered and the drainage of the lands of such district or a portion thereof be prevented, impeded, retarded or endangered, or the overflow of such lands or a portion thereof from the works so injured, impaired or obstructed be caused or endangered.

    (b)

    Districts under 1907 act. It shall be unlawful for any person, without permission or authority from the board of directors of any protection district in the county organized under an act of the legislature of this state entitled "An act providing for the organization and government of districts for the protection of the lands of farming or other communities or neighborhoods within this state from overflow or damage from the waters of any unnavigable stream, watercourse, canyon or wash extending by, through or over such communities or neighborhoods, and to provide for the acquisition of lands, rights-of-way and other property by purchase, gift or condemnation, and for extending, straightening, locating, improving and maintaining the channels of such streams, watercourses, canyons or washes, and confining said waters in such channels and preventing the overflow thereof, and for the construction by such districts of the necessary works for said purposes," and approved February 23, 1907, and acts amendatory thereof, to dig in, into, upon or through any of the works of any such districts or impair or remove any part of the levee or banks or beds of any channel or obstruct any channel constituting a part of such works whereby the strength, sufficiency or efficiency of such works or of such levee, bank or channel may be impaired or endangered, and the protection of the lands of farming or other communities or neighborhoods within such protection districts from overflow or damage be prevented or endangered.
